Nintendo 3DS Users Playing Pirated Games Are Being Banned

As you may have already heard, a number of hackers have found a way to play pirated games on the Nintendo 3DS. As you would expect, Nintendo is aware of this particular issue and is currently in the process of banning users that have been using a special exploit. Here’s what one frustrated user wrote on the GBA Temp forums.

“Users in multiple countries have been getting error 002-0102, which normally means an internet connectivity problem. However, after contacting Nintendo, multiple users have confirmed that the CS says its a ban. They offer no further information at this time, and can not overturn it. As of now, there is no solid evidence that it is a NNID ban, and most conjecture/circumstance points to a MAC/SN ban. Users that are banned can still enter the eShop and purchase games, and download updates. They can not go online within any game or use their friends list. They also can not use ANY application that requires online connectivity, including Pokemon Bank, YouTube, and Netflix. However, the Web Browser DOES still work.”

    1. They had it coming. I’m so happy they got banned! I like the games, and i work hard to earn each game i get. If i don’t have the money for a game i want, i just wait ill i have the money. Nobody likes to give their work for free without a reason. Damn pirates, why don’t they go and fund their own videogame company and develop games and give them for freem… not cool huh!!

  3. How do you even pirate a 3DS game? I’m sorry but I don’t feel bad for those who were banned since it is illegal. They know it is.

    1. There’s a thing called gateway, you can put micro sds in it that you store the games in. It’s still expensive and not convenient at all. You can only put one game per sd so you’re paying something anyways. Not as much but hardly cheap if you need to pirate. Like, if you’re poor then you still wouldn’t be able to afford it. Which makes the gateway stupid.

      1. only in the beginning it was limmited to one game per SD, after that they added features like rom dumping, multi-rom and more. And mostly users using the sky3DS Flashcard got banned, because they couldnt dump there own Games and had to use the same Cardrige ID for all Games, because of the tool that is needed to put Games on an SD for usage with the sky3DS.
        but some of the people who used the Gateway with a public or shared Cardrige Header ID got banned too.

      2. Wrong, you can have mutliple games on a single SD card nowadays. I have one and personally use it to carry all my games around on one card, because carrying 26 games just in case I want to play one is not practical at all.

            I did this with the regular DS as well. I owned well over 30 games for it, and as someone who frequently went on business trips it was a damned hassle to carry them all with me, especially since I suffer from video game ADD and jump from game to game a lot. I bought a ROM cartridge and was able to play all of my legally owned games without having to carry them around. It allowed me to have the best of both worlds of physical and digital. I got the convenience of digital games, with the benefit of still owning the game cartridge and case, which I enjoy physically owning.

    1. Companies don’t go after petty thieves. Everyone knows this. They “say” not to pirate music, games and movies, but really no one ever gets in trouble for it unless you run a huge black-market business.

      In reality, too many people pirate things to justify prosecuting every single one of them… over half of the worlds population would be put in jail lol, because that’s how many people pirate things.

          1. hem people say pirating but don’t know what it is really , you could just buy a flashcard ( 20 to 50 $ if you buy a micro sd with it ) and download the software of the flashcard. then you download the roms, it’s as simple as that if you play on a real console, if you don’t then you could just download an emulator, get the roms in there and voila ( emulators ARE legal only if you possess the console and the games , so technically it’s not piracy ? )

It’s not legally classified as stealing, so the only thing they can get you on is copyright infringement… which is pointless since the most they could do is have you fined for the lost income.

  5. I own a R4 card for old DS games. I haven’t been banned. Guess it’s 3DS flash cards only. ( aka gateway ) I do actually own about 50 legit DS games and 40 3DS games. Just saying. I only use the R4 card for stuff that was never officially translated into English and games that you can’t buy cheaply new anymore, which means the game devs wouldn’t get money for the game anyway. Only cash hungry ebay whores are making money on them. :P

          1. I think you’re overreacting, and perhaps very naive. Companies need to localize their games and make them available if they want any money from consumers.

            For example, Square Enix is waffling on whether or not they are going to bring Bravely Second over here. If they decide not to bother localizing it, they would be to blame for people pirating the game, not the consumers. It would be Square that didn’t give consumers any options. They know people in the west want it; therefore it’s their responsibility to get it over here. If they don’t, I won’t pirate it myself, but I won’t blame those who do. In fact, I would wish them all the best.

            I won’t defend pirating games that have been localized and are still in print and/or easily available on the eshop. If people do pirate the game due to the total lack of availability, they should later purchase the game if it gets released on the eshop or reprinted or whatever. They should also look to see if they can get a used copy at a reasonable price before resorting to piracy. But feeding the scalpers on ebay isn’t a good option either. No one should have to pay a hundred dollars or more for a used game. Also, some of these ” game collectors” will leave a game sealed so they can really sell the game at a marked up price. Screw these scalpers that don’t even open the damn game. People need to purchase games with the intention of actually playing it at some point, not so they can keep it sealed and sell it at an insane price.

            I wouldn’t ever pirate games myself, even for unlocalized or out of print games since I don’t want to get into any kind of legal trouble, and besides I lack the technical knowledge to do it. But I’m not going to get angry at people, claiming it to be immoral or unethical to pirate unlocalized or out of print games if they aren’t on the eshop. If they are on the eshop, then the games being out of print isn’t a good excuse at all though.

              There are many movies which aren`t shown in every country worldwide- since they are- you guessed it- NOT LOCALIZED- the Hell Harry Potter the famous book didn`T came out in every country worldwide, just in certain ones and in certain languages. So when i take your logic – you say its fine to pirate Harry Potter the book since you know “It didn`t come out in my country and i want it”???

              So i take your logic and you say:

              Well i really hope they steal your car. Lets hear your excuses then. Will be funny when you are realising that its allways a 2-side situation. There are allways 2 sides which matter. Not only One.

              For example:

              If someone steals your car, the THIEF has a fault because he stole it- but also you have a fault, if you didn`t secure it like you should. If you secured it like you should then you have nothing to worry about. The problem is: Many people don`t secure their things like they should. So they are allways AUTOMATICALLY in fault!

              Another example:

              If your house is open, you leave the key right under the doorstep…and you try to sue your insurance to get your money back because they stole you something- because you know the house was open…

              Guess what happens then? YOU ARE GOING IN JAIL MY LITTLE FRIEND FROM THE MOON!

              And why? Because you didn`t do the right things to secure your house. Sure, the thief will also have a hard time in prison. But you too because you tried to get your money back WITHOUT HAVING THE RIGHT TO!

              So what did you do wrong here in this scenario? You didn`t rightly safe/secure your house from thiefes.

              And that my little friend is a lesson for LIFE! Insurance-fraud is a VERY HEAVY CRIME AND CAN GET YOU IN JAIL FOR MANY YEARS! It can literally ruin your life.

              So you say- if someone doesn`t release a game in the country you live in- or well some company just decides to not release the game in your language…

              Btw: If a game doesn`t get released in my country or in my language i simply will not bother about it.

          “Well, i don´t have the money so i just steal your car”. Its exactly the same. The car is stolen and the people which would have sold it to you have the damage. And you get into prison for it because that car will be soon found and you will be arrested and punished for your stupidity.

          Its like saying “Well if you don´t like the game don`T buy it”. Sure that might be true sometimes. But if there is no more choice to go elsewhere, you are literally damned to do that and buy the game cause well- you have no other choice right?

          Thats how it goes.

          Nintendo cares only about, that YOU have to play something different if you doesn`T have the money for their games.

          So- what would happen if you would have to play something different?

          Lets make an example:

          You have the choice to:

          a) pirate on other platforms if you will be banned on Nintendos Platform. But then you might be banned there too (See on PS3? People were also banned- like on Xbox 360 too- and the more tech is in the consoles, the more intelligent the system will be- and the higher the possibiliy you will be even sued by LAW and THEN the problems you get in will be really big. And there will be no more excuses for you. The judge doesn`t care if you whine about that you didn`t have the money.

          People which pirate famous music are often damned to pay 100.000 dollars. And their life is ruined. But they DESERVE IT! They chose to go the bad way. Now they have to deal with the consequences which should have been clear.

          b) You can play “Free 2 Play”-games (which are never free, its just the usual method, you pay with your user-data which are sold all over the world, it just works like having “Angry Birds” on your Iphone/Ipad => your data has been stolen/Sold if you played that game ONCE on your device.) Sure it seems free for you. But your data has been stolen and/or sold to other comapnies. to nerv you in the future with more adverts in your email-accounts/SMS/Smartphone-number or even in your real post-account. Some Free2-Play-games also use other methods to get your money. So its never really free.

          Just think about it for one second: Why should a game be free? Theres no point in making games for free. People- and with people i mean 99,9% of the people are making games to make MONEY. Not for having pirates pirating them and letting them get away with it.

          See? Thats how it goes. There is no free game. Even Angry Birds is not free, as Edward Snowden has proven that you paid with your user-data for it. You are being spyed when using that game!

          Nintendo doesn`t care if you steal their games or – to circumvent that “piracy”-word, you don´t have enough money to buy their games.

          If you don`T have enough money to buy their games you are damned to play other games.

          AND THIS IS EXACTLY what Nintendo is about.

          It doesn`t matter if you haven`t got enough money.

          You should better go playing Free2-Play-games now and play with your data- than stealing more games and 5 years later you are going to jail.

          And trust me: The longer you wait with stealing games, the harder your punishment will be.

          And get it: If you steal games or do other such things in certain countries, your HEAD or your HANDS or LEGS will be amputied!

    1. This was basically emulating older games like SNES and GBA on 3DS.
      That was also the only reason I still have my normal 3ds. I got my new 3ds xl just now

      1. I pirate games to try them out. If I enjoy them, I buy them. If I don’t enjoy them, I delete them. No lost sales either way. I just use it as a demo. Play an hour and judge the game from the hour I played.

  10. Correction: users playing .3dz games with shared headers online are getting banned. No reports from users playing CIA files, which use the system’s header.

      1. what does “well-paid” mean? Do you know how many millions (or even Billions) of people right now have to do nasty jobs for their money? I do spread news-papers (as a 2nd job btw) and i only get ~250 dollars for that! Thats 10 hours per week- and thats only the work. You need to drive there too (30 minutes per each day) and then you have to SORT the letters you spread!

        So thats about 20 hours per week of hard work. For 250 dollars a MONTH!

        Guess what? no one likes that hard work. But its the only way to be legal. And 250 dollars is not that less as you think. You can do a lot with 250 additional dollars per Month! Its enough to live from it if you don´t have to pay other things from it. You can buy ONE CONSOLE per month with that Money (wiiU costs about 250 dollars). Or 4 console-games (each 60 dollars = 240 Dollars total) or 2 console-games and 3 handheld-games.

        And for me its now only there to support my pocket-money (100 dollars per month, way too less)- and to get me buying more console-games (which are expensive, 60-70 dollars each!).

        If i were you: Do the same. Its worth it. being legal doesnt mean your account (NNID) can be banned. And no wasted time spending for updates of flash-cards or having to worry about each day now being banned or the thing is not anymore working. Nintendo will now allways be ahead.

        Thats the future now. This is not 1990 anymore where there was no intelligent tech. The 3DS is a constantly checking device. It constantly checks an KNOWS what you do with it and loggs everything. Its not a Wii anymore where you could hack and there nearly was no protection against it. The DS didn`T check its licences via Internet. The 3DS does this! Like any modern console btw. You will be banned (either your NNID or your licences in your 3DS will be voided) if Nintendo finds out that you pirate. Just that simple. And there is NOTHING in this world which can safe you -besides- having the money to buy those games.

        Oh and btw: Nintendo allready confirmed that because of the many ILLEGAL DOWNLOADS,

        they didn`t bring out Star Wars on Wii (it was cancelled because of too many hacked Wiis they didn`t see any more point in releasing that game => too high bugget => too less real buyers) – and Donkey Kong Country Racing 2!

        See? Being illegal also means => less good games for you. Just logic. Why should Nintendo bring out that games if people pirated all those Wii-games?

        No, Nintendo is smart when they decided to not bring those games to the hacked Wii anymore. They simply ditched it. And i can deal with that, can you deal with that reality?

        Think about if you were a pirate- you are in fault that Wii missed 3 HUGE 1st-Party-games!

        A complete Starwars-Game was ready for Wii! It didn`t came out because => To many pirates!

        A complete new Donkey Kong Racing Game was ready- it didn`T come because of Pirates!

        And Pikmin 3 has switched to WiiU (and thus didn`T came in launch-window of the console like planned) because of => too many pirates. There simply was NO POINT in relaseing such a huge project on a hacked console.

        I know times, when people bought harddrives full of HUNDREDS of illegal pirated games. And that was on Ebay! You would be really stupid if you think Nintendo does not see that there console was hacked. Why do think that the Software-support of Wii ended in 2011? Did you think it was random or what? No, dude. Nintendo decided to simply ditch Wii-development and wait until next console is out, to don`t lose more money because of too high piracy. Thats why Xenolade Chronicles- The Last Story and Pandoras Tower- as well as Skyward Sword (Zelda) were the last games for Wii. The support ended in 2011 just when the console was hacked completely and from there on, only some cheap thirdparty-games came out on Wii. And then it died.

        And thats is btw. also the case why they decided to switch Pikmin 3-development to WiiU instead.

        Guess what? Because WiiU is SAVE! Save from Hackers (Until now) and save from piracy and they have the same strict and punishment-system like on 3DS- no hacker has a chance against it.

        And i like that. That is exactly what i want. NO hackers in my online-games (not in Mario Kart, not in Smash Bros, not on Monster Hunter Tri or other games)- and no pirated games means => Much more games to come for WiiU since there is a point to make more money since you cannot pirate them ;)

        But what is sad now is that Nintendo might decide, to NO BRING THOSE 3 games to WiiU, since they want to punish all people for what the hackers on Wii did!

        We simply will lose those games now because of those dumb hackers which pirated too much on Wii. Sad isn`t it? Can you live with those facts?

        1. you say that but then explain why wii-u is failing so badly.. because no pirates. The primary reason Wii got so many games in the first place and was so big was because so many people bought them to play pirate games. Now Nintendo has had an entire generation where their only saving grace is their handheld which is popular due to the number of people are using the system and a LOT of them are using flashcarts, either legitimately or not but pirates still buy consoles which makes the platform numbers look good.

  11. I haven’t and never will pirate games. Not even untranslated or out of print games, since I don’t want to deal with any legal issues, and besides I don’t have any technical knowledge of how to do it.

    But in the case of untranslated, or out of print games that aren’t even on the eshop, I can understand why some people would. Game companies need to translate their games, and make them available if they want our money.

    For example, Square Enix is waffling on whether they are even going to localize Bravely Second, even though they know that we want it over here. If they don’t bring it over, I’m still not going to pirate the game; for the reasons I mentioned. But I wouldn’t judge anyone who does. I would put the blame on Square Enix directly for not localizing the damn game, instead of the people who pirated it because Square gave them no alternative.

    Well, the legal way of playing it would be importing a Japanese 3DS, and downloading it on that. But it would still be an untranslated game. Even if Nintendo removed region locking, it would still be an untranslated game! I wouldn’t want to play an untranslated game for free, let alone pay for it! Not to mention spending the money on a foreign 3DS in the first place. If Square decides to not bother localizing the game, I wish the pirates the best of luck in playing the game illegally.

    But I wouldn’t defend people pirating games that have been localized, and are still in print and/or easily available on the eshop. If someone does pirate a game due to the lack of availability, they should purchase the game later if it’s put on the eshop or something. Regardless of whether or not they actually want to play the game again or not.

Honestly I’m glad that Nintendo is taking action against this, but I don’t have a right to say that as an owner of an R4 card for my DSLite :\ My only reason for getting one is because it would be expensive as heck to buy every game I wanted to try since I missed most of the DS generation of games. I am however very proud to legally own all of my 3DS games, and even the few DS games I bought of my favourite series.

  13. I am a bit neutral on roms. If you don’t supprt the official releases then roms are misused and should be punished. The only exception is if a game isn’t localized or you own the game and lose it imo. I don’t use roms, but pirating can cause major problems with companies profits.

        And wait for it…the longer the consoles are in the future, the more complex the tech of DRM/online-checking will be.

        The less chances hackers will have to circumvent such systems.

        Another flaw right now for hackers on New 3DS:

        They cannot use their amiibo WITHOUT having to switch on the wifi (and 3DS starts to search for Internet- to search for licence-checks and updates etc)! HAHAHAHA! :)

        Now i understand why there is no SEPARATE Wifi-switch anymore.

        They just ditched it and- to make it harder for hackers- no more wifi-switch and if you want to use Amiibos => no way around without using the Wifi-switch. Sure, it does not mean that you cannot switch off your router and it still works…but wait for the updates on New 3DS. And: Your neighour mighthave its wifi open and your 3DS can use it- and you simply don`t know it. Means: You can never be sure. It can mean that your 3DS will be banned while using Amiibos because Nintendo saw what you did with it and checked your 3DS-white/Blacklist and gave you the ban. Hahahaha.

        New 3DS just has started one month ago. The updates will come which offers so much anti-piracy that Smealum will burn in hell :) Smealum allready regrets doing what he did. But it won`t help him out of the trouble now. The damage is done.

        First companies allready said- if the 3DS gets fully hacked there will be no more games from them. And thats another point why the New 3DS is more save now. More protection for every hacker out there. Will be funny when they find out what the New 3DS-Antihack/Anti-Piracy is about :D

        1. Smealum didn’t offer a way to pirat games, the exploit he released is only a user mode exploit wich only allows to run homebrew, without a arm9 security kernel exploit there is no way to pirate games on the 3DS.
          Also even if the DRM will be more complicated, the software will also have more flaws, thats the problem with complex software. Also there are other ways to get informations from a closed system for people with enough know how, like dumping the ram on the hardware site.

        2. new 3ds has already been hacked and has pirate software on it. Also, you POV is flawed.. iPhone has been hacked for years and games still come out on it every day, NO system is 100% safe and all get hacked eventually.
          Pirates just go after the most popular ones because there are more people working on it.
          For every system they put in place there will be a way around it, such is the nature of such things.
          They have been trying to stop pirates since the NES and it STILL hasn’t happened, for all the new Antihack/Anti-Piracy its all meant shit.
          Like it or not Piracy is here to stay and will continue as long as there are things people want but cant afford.
          For a start, 3DS games are upward of £35-£40 now in some places, GB games used to be a lot less and the games were a lot bigger quite a few cases.
          The trouble is gaming has become such a huge market that everyone wants to cash in, pirates do what they do because they cant afford what the companies want to charge,
          Until that is solved pirating will continue.

  14. Well, pirating does kill the industry, and we do not want that, so I think Nintendo made a good move here. The fact that you can still play the games you pirated is more likely pretty indulgent. I do not think that people can argue about this ban.

  15. While I’m totally against illegal pirating as it’s like shitting in the devs’ face, I can’t stop feeling bad for some people who can’t afford many games. Not everyone makes over $20k a year, y’know.

      Dude nearly no one has so much money. And no one needs 20.000 dollar per YEAR for 3DS-games. Lol. How many 3DS-games do you buy? 20 per month or what? Lol, what a lame excuse xD

      I pay 500 dollar per YEAR for my 3DS-games. THats one game per month, and sometimes even 2. Thats 50 games till now (from 2011 on counting).

      Thats 2000 dollars in 4 years! Nothing about 20.000 dollars.

      Man, how lame! Go home. Get a job or get banned soon.

      Btw: There aren`t even so many 3DS-games to buy- for 20.000 dollars. I would say if you are paying 5000 dollars now you have ALL GAMES! At least all retail-ones which are good. But who is going to play that many? I guess no one.

      I have 50 games in 4 years and thats enough. 48 months = 4 Years = each month 1, sometimes 2 games. And dude? 50 games…lol i have a console too- and a PC. Sooo much games, so less time to play them. See? Thats the problem. You play hundreds of hours with Monster Hunter 4U right now. Theres no way you get through these 50 games in just 1 year.

  17. If it were stealing ,the copy from where you got it from would not be there any more. If someone stole.your car but you car is still in your driveway would you give a shit…I don’t even one a 3ds just throwing a point of view out there and just because I’m a tech nerd. Couldn’t people find a way to change that ID so that it wouldn’t have a shared one anymore?

  18. While I understand pirating is illegal, if Nintendo would just release the same games pirates are emulating then perhaps there wouldn’t be such a huge problem. Most of the time pirates are playing old Nintendo games or Japan only titles. You think Nintendo would take the hint and release these titles and make money, but Nintendo sees it as “people are messing with our hardware and playing games we don’t want them to have access to.” Maybe one say we’ll have a system that is region free and/or a console that could play (through buying and downloading) all virtual titles.

  19. On my 3ds, I got a R4 card which I got a GBA emulator on and only a few old DS games, which a few of those is what I own myself (because I don’t like to bring 10 cards with me when I’m outdoors). The list was much bigger, but I deleted those I didn’t like.

    I’m totally for Nintendo acting against piracy, but atleast they should make it possible to emulate/download them for a small price (like 0,99ct)
    + They should also see it as some kind of advertisment. People play the game for free, if they like it, they might even buy the new game on the console they still have to buy (I grew up with SSB and Zelda on the N64, so it was obvious I would buy the Wii-U :P).

    I myself just finished Majora’s mask (which I didn’t own myself on the N64/gamecube). I might just buy the 3ds version, because the game was pretty good (I bought several games that I ‘pirated’ before, so who knows).

    as someone who lives in the third world country, pirating is not unusual around here. In fact, many people here are finding profit from pirate games.
    Heck, you’ll be surprised. Only rich people do own PS4 or XBOX 1 or PSVita or Nintendo 3DS.
    Meanwhile middle class or lower could only afford nintendo ds or PSP or PS2 or PS3, because all of them can play pirate games for now.

    My country is even not on the list in Nintendo 3ds. (Indonesia)
    As a gamer it feels kinda unfair.

    That’s why as a gamer I envious with people who live in the first world country. If you could afford original games in just working 1 day (8 hours with the rest of money for living). We have to work for several days to afford 1 original games (assuming if it’s an office work or make 250-300 US$ per month.)
    the price of the original games kinda shocking

    and sometimes some games feels like didn’t worth the money they spent.
    So I can blame them if they were so desperate and begging for pirate games.
    Call them whiny little if you want

    That is the struggle of gamers in a third world country

  21. Piracy is nice, get a CIA instead of 3dz

    this is why CIA files are bae asf, they use system headers so you won’t get banned for piracy kek, i don’t mind 3ds piracy, i still buy 3ds games, but i also pirate sometimes with my beautiful gateway card

  22. lol I love how all the haters just combined in one place to ramble on about how bad Pirates are. xD Pirates look at you idiots like sheep standing in line to use money on expensive software from these companies. Also, these pirated games do work online. If you know how to get past what nintendo looks for, which everyone does.

    Still pirating games, still playing online. No ban.
    Y’all better keep giving Nintendo money so I can enjoy more free games that they release. :)

  24. I got free games on my 3DS too, and didnt got even caught lol, i pay enough for the consoles,
    By the years i have all nintendo consoles but 3 missing, Wii U , N64 and the normal NES.
    And its funny and i can just laugh about some comments here xD

  25. I don’t care about pirates, it’s somewhat harmless, if they start cheating or hacking (therefore taking the fun out of the game) then that would be a REAL problem
