Tom Mayhew’s eight-year-old son found pornographic images on his apparently new Nintendo 3DS console. The console was purchased from US retailer Walmart in Hampton, Virginia under the assumption that it was new. The images were found when the child took photographs on the system and then went to view them. Mayhew believes that the Nintendo 3DS may have already been purchased and then returned to the store, but the files were not deleted by staff. Here’s what he had to say.
“He went to play his games, not knowing anything was on it. After a while, [the kids] took pictures of themselves and when the picture was taken it went to a file. When that file was opened, there were already pictures on it.”

You all are missing the point…It wasn’t The previous 3ds owners fault, It was Walmart’s fault. It’s the staffs job is to factory reset any device that contains information unless it’s a pawn shop or some cheap trade in store. The fact that Walmart even TOOK in that 3ds and labeled it as a new system could mean that he must have bought it new and kept the receipt then returned it a few days later. the possibily could be the opposite. Nevertheless, When they put a system back on shelves, It’s supposed to be factory reset (At least in my experience at walmart over here). The only way I can see if it’s the previous owners fault is if they meant to deceive one of the clerks and tell him they already reset the device ( the the clerk was stupid enough to believe and NOT check what’s inside or if they looked into the 3ds. the home menu would be empty but photos still existed.)
Some staff members of walmart are known to be oblivious. Like last year when someone returned a “3DS” and a parent bought it for their child on Christmas to find out there was only a rock inside.
In my opinion. It’s the STAFF’S fault for not paying attention and not learning from their mistakes. I’ll blame the previous owner as well, although we don’t fully know if it was his/her intent to take pornographic pictures and return it so a child could be traumatized. It could very well be that someone took pictures and unknowingly left them on their SD card then tried to factory reset (Factory reset doesn’t delete SD card files) then returning it without notice. Maybe they forgot to remove said SD card. but all I know is that Walmart is to blame for their lack of awareness.. Fool me once Shame on you Fool me twice (And possibly many more times) Shame on me.

Agreed it’s most definitely the stores fault. Also, even though it’s not the fault of the parents at all, perhaps it will do some good to remind parents that games aren’t just for kids, and to double check on games that are above the age of the child, double check internet settings, and so forth. I’ve seen a few reviews of 3ds games like Driver for instance, where a mother complains about the swearing and dead hookers in it, when it is clearly marked as 18 on the box. A 3ds also has access to wireless network if yours is unprotected or if the kid knows the key for it. I have on occasion used my 3ds browser to view hentai manga online so even though you can’t visit things like redtube, the kid would still have full access to porn if it was a curious young teenager. If you don’t want them looking at that stuff you should be more involved now as a parent, in Ireland at least most parents seem to think there are no 18+ games, and don’t realize that everything can access the internet and porn these days.
It probably WAS factory resetted, but they forgot to format the SD card.
The SD card that comes with the 3DS is technically not part of it, so it’ll be unaffected with the factory reset.
The 3DS doesn’t store the photos within its system memory. It stores them within the SD card.

I already said the 3ds SD card cannot be factory reset.
And the 3ds CAN store photos in the system memory. Go to your photo application and look at the pictures. if you have a white border on your photos, its on system memory, if you have a grayish border, it is on the SD card. It even has an SD card to system memory transfer tool. For a better experiment. take out your SD card and take a picture, then view it, it will have a white border, put your SD card in again, while still on the photo app and it will ask you if you want to make the SD card the main SAVE directory. say yes and Take another photo and view it. It will have a gray border… I have done this plenty of times dealing with high quality Colors3D pictures
P.S: I know well enough that an SD card is not apart of a 3ds
i work for walmart in electronics department. A customer returned a 3DS and I took it to claims for processing. They looked at me like I was dumb and asked me why I didnt put it back on the shelf? And I was like “last year gamestop did that and some kid said he found porn on it, so I think we need to send it back”. Needless to say, this shit happens. Lol

If you’re going to take the risk, do adult rated stuff and return it, please remove stuff you don’t want a kid see-ing it (for example, moving it to an sd card, if you wish to keep it for your own amusement, ect)

Just explain to the kid that is something for adults and he’ll understand that when he grows up, and that probably someone at the store or someone that turned it back put it there. In USA you guys turn back EVERYTHING and RESELL EVERYTHING, here in Latin America stores rarely let us turn back stuff unless they’re fucked up completely from purchase. Anyway, shit happens, and that kid in his teenage years will discover porn like everyone else, big deal. Just be a good parent, and explain things and fix them.

Clearly Walmart needs to better educate their employees. I used to work on service desk and part of policy, no matter what state you live in, is that anything that is returned with memory must be sent to claims. Claims is essentially damaged items. That 3DS was obviously returned and should have been sent to claims, which would then be shipped back to Nintendo to be recycled or whatever. It doesn’t matter if it appears to be sealed, it HAS TO BE SENT TO CLAIMS. Seriously Walmart hires the most ignorant fucking people. That’s why I left that shithole.
