Nintendo Copyright Claim On GameChap’s Super Smash Bros. Leak Video Dispute

Update: We have been told to delete all the Ryu, Roy Smash Bros posts via Nintendo so I will have to take them down.

YouTube channel, GameChap, have began somewhat of a campaign against a copyright claim Nintendo of America filed against their video focusing on the Super Smash Bros. leaks. They received the copyright complaint and had to remove the video, but are adamant there was no copyright issue and have been singled out, as other channels reporting the news had no such problem. They’re asking people to get involved and get behind them on YouTube and Twitter. What do you think of the dispute?

  1. I think people need to learn to be patient, it’s really annoying when they ruin whatever plans Nintendo or any other company has plans to release the info and it just kills the moment.
    You’ll probably say “if you don’t want to see it then ignore it!!11!1” as if it was that easy, things like that pop up everywhere online.

      What you are arguing is not a law or based on any sort of ownership regulations. You are trying to turn this into some moral debate when it is truly up to Nintendo to decide how their franchises are shown, portrayed, and whatnot.

      It’s not “bullshit.” It’s just a different course of action from the one YOU want to happen.

  2. What? Nintendo are claiming videos because they’re leaks, they have the right to suppress any for of leakage. Anyone willing to post video of the content is just asking for the strike. The video maker is in the wrong here.

Plus the major difference here is, unlike channels like GameXplain, they probably posted actual, RAW, footage, whereas the channel I mentioned above only talked about the leak and only showed images, pictures, no video footage. I’ve never seen Nintendo take down videos like that, but once any kind of leaked video footage goes up, that’s when Nintendo gets all over it and will hunt down each and every Youtuber who posted that footage, so it’s also their fault for deciding to post the video and not the pictures.

  3. If it was anyone else, I might have agreed with them. The problem is, It’s Gamechap who are leading this who I don’t have any sort of fondness with after their ‘short’ amount of time with the Yogscast which ended after they posted a very malicious post towards the fans of the Yogscast.

  4. Anyone posting videos about the leak or featuring footage deserves to get the strike, they’re basically inviting it. It’s unreleased Nintendo content. We all know what Nintendo is like with just their content on YouTube, now it’s a leak too.

  5. I’m not fond of Game Chaps videos, but they certainly don’t deserve a copyright strike for simply reporting on news that everyone has access to. That’d be like suing a news program just because they reported something critical on a large company.

    So actually, for once you can’t actually say, “Nintendo were right to take it down and strike it” because they actually weren’t. News and reports on information has no ownership. Only the leaker can get into trouble and no one else.

    This is another case of people assuming Nintendo owns everything to so much as a mutter of their name. They don’t. People can talk about things.

      I’m sure if Game Chap was following all the rules correctly, then their videos would not have been taken down. If they are showing leaked footage than Nintendo ha sa right to claim the video. If they are not registered with Nintendo, then Nintendo has the right to pull the plug as well.

      Don’t break the rules and don’t get your videos taken down.

  6. I post Nintendo content all the time on my channel. Nintendo will claim it but all you have to do is register the video with them and it is monetized again. A claim, not a strike. They are getting strikes because the content is leaked. Capcom did the same thing last year when people leaked info on Street Fighter. And several channels have been careful to not show the actual footage, including popular youtuberer Etika.

  9. You mean a video that is ruining a surprise for E3 has been taken down? No, that means these poor bastards won’t get paid for something we’ve heard over 5 times already…

    Seriously, I hate leakers and these guys are no exception.
    I’m actually trying to avoid leaks but everyone seems to be showing them out in the public like mad so I can’t go one foot on the internet without hearing a leak..

  11. I get why you would get mad but Nintendo never intended for that information to go public. It’s weird that Nintendo chose Game Chap first as other channels showed more information but if others get taken down you know why. This has nothing to do with Nintendo’s copyright claim on YouTube this wasn’t “public domain” in the first place

  12. While I don’t always like it when people post leaks and spoil the surprises, I don’t think Nintendo should be enforcing a law suit. I think they’re just very angry they’re stuff got leaked, which is understandable, and are trying to make an example of these guys so that no one will ever do it again.

  16. Nintendo is actually taking down every Smash 4 Leak video, including the ones by EtikaWorldnetwork and Gamexplain.

  17. STOP LEAKING STUFF THAT ISNT YOURS TO LEAK! This shouldn’t even really be a discussion. How dare these “youtubers” be so pompous and entitled. But I’m sure a ton of idiot “youtubers” will be behind these guys. Nintendo has full right to take any action needed to take people down who leak their content… ILLEGALLY

    1. None of the youtubers leaked anything. It was some guy on reddit and then reported on YouTube. Reporting on a leak is in no way illegal.

  18. i was reading the comments of the video and dear lord its full of idiots! they talk bad about nintendo and keep saying that nintendo was stupid enough to leak the videos! my hands just clutch in fist of rage!! those morons shouldnt spread the leak and they blame nintendo for striking them when its them that they should mad at! >-<

    It really makes mad! its not like they are running a company, so leaker could reveal their secret information! i wouldnt be surprised if nintendo stop making surprises for us thanks to this morons!

      Of course Nintendo will not stop making surprises… that’s a ridiculous solution. Nintendo will just have to find a way to prevent leaks from happening. Problem is, the Smash Bros. ones seemed inevitable given that a bunch of hackers explored Smash Bros. content that was being uploaded for a upcoming update. I can’t really think of any solution that would have prevented the leaks aside from not uploading the content early (which would mean, it might take longer for people to download it in the end and a release date would have to be pushed back) or to make it harder to hack, but that option sounds like it would have issues like spending more money to hide content details on a simple DLC pack and taking the time to do it in the first place when a little leak really isn’t that big a deal in the grand scheme of things.

  20. Nintendo property. That’s the risk you take. If you don’t like it then upload something else to your channel, like non-Nintendo related stuff. I think there is plenty out there to focus your “talents” on, no one owes you anything so stop crying.

  21. I don’t think the issue is about keep the secret, it’s about they use nintendo content, and Nintendo has all the right to take down, specially if it is monetized. If someone thinks that is wrong, so the problem is not neither you tube, nor nintendo policy nor nintendo, the problem is about the hole Copyright system, then if someone doesn’t like that nintendo take down his videos he must protest against the copyright system but not blame Nintendo.

  22. They deserved it. No one should spoil surprises like these. Heck, I felt no excitement when I saw the Smash Direct, because I knew what will be there !
    The only things I was hoping for was for my Smash Ballot choices to appear. But guess not… Until next Smash Direct…

    I’m sick and tired of these leakers. They think they’ll be praised for showing unreleased stuff but that will only attract Nintendo’s wrath.
    I hope next Smash Direct won’t be like this.

  23. Thanks alot to youtubers and leakers for spoiling all the cool stuff going on at E3. Even in Smash Bros 50-facts video spoils all the smash fans and the secret boss uncensorly revealed? Nintendo, I like your games and other stuff, but you REALLY have to prevent stuff from gamers giving gamers some spoilers (no NOT the person who spoil stuff, in general). I really don’t care if see some spoilers, I can STILL see it and play games I haven’t played before.

    1. Also, why did they single down this site. Man, the Security can stop outsiders, but not the actual employees on Twitter. Might as well get them to watch them while they work. Now that I think about it, they may be stealing those rare Amiibo. Anyone think the same?
