Pokemon Company Has Withdrawn Settlement Offer For Pokemon Fan Party

I’m sure you are all now aware of Seattle cafe owner Ramar Larkin Jones who has been hit by a massive lawsuit by the Pokemon Company for throwing a fan enthused Pokemon party. Jones was only charging $2 for entry to the event which went towards things such as competitions, etc. Well, today it has emerged that the Pokemon Company has had their team of lawyers revoke the settlement.

“We had agreed to a settlement. Once the story broke on motherboard we got a email saying they were pulling the offer because I was bad mouthing them tho I was not. The lawyer I was working with is trying to get them to put the settlement back on the table so that we can be done with this entire thing. we should know by the end of the day. We have the emails going back and fourth where their lawyers say we have a deal.”

    1. Unfortunately, this kind of misinformation drives me nuts, but Nintendo =/= Pokemon Company. Pokemon Company is god awful with this sort of thing. Nintendo I don’t think would have any problem with this. The Pokemon Company is owned by Nintendo, but they hold most of the controlling interests of Pokemon and often have huge restrictions on what can be done with the Pokemon IP.

      For example, in Smash Bros. Sakurai has stated its actually difficult to work with even the Pokemon Company due to the way they function. Anything the Pokemon Company does like this has nothing at all do with Nintendo, and certainly nothing to do with the Wii U (the Wii U has even actually made a profit now, so they haven’t really lost revenue on it, though they didn’t make MUCH of a profit off of it).

      The Pokemon Company is technically owned by Nintendo, but they are a lot like a third-party in regards to how they treat the Pokemon IP (barring the fact that Pokemon is exclusive to Nintendo platforms). Its a really weird relationship the Pokemon Company has.

        1. You’re only half right. Those three companies don’t own the Pokémon Company. Instead, the Pokémon Company are an affiliate with them. In business terms, that means that they are an independent company that shares a relationship with a bigger one.

          Incidentally, Creatures Inc. is also an affiliate of Nintendo…

          1. No, they’re not. They’re actually a fully bonafide third party company. The only reason why they seem to be owned by Nintendo is because they’re better known for making Pokémon than for their other games.

            Case in point, Click Medic and Tembo the Badass Elephant are games released for the Playstation 1 and Playstation 4/Xbox One/PC, respectively. Both are made by Gamefreak. They also released Pulseman for the Sega Genesis.

        Being a computer, you’d think you would automatically side with what is more logical, not what is written to be, by humans. And no matter how anyone tries to spin this, I don’t find anything logical about suing people over fan thrown parties.

    1. What’s a real joke is the fact many people all over places like Craigslist, Etsy and eBay sell Pokémon merchandise without a license to do so, you’d think hunting those people down would be much more important than this poor guy.

      There even used to be some guy who posted a bunch of shirts he sells with Nintendo characters here, he doesn’t have a license to sell Nintendo merch, yet he still does in mass and no one is bothering him, nor is the Pokémon Company.

      1. This man has been doing this for five years, ignored C&D orders, has a personal relationship with the owner of the venue where the events took place and had a stake in catering them.
        Plus, he has already raked up more money than he needed to pay the settlement.
        All he needed to do was lie low and negotiate a payment plan, instead he purposefully took to the media to bait ignorant fans into giving him more money by tarnishing TPC’s reputation.

          And don’t you think The Pokémon Company could have easily stopped this event in a much nicer manner, and saved face amongst fans who do not agree with them doing this. Like simply asking the guy to sign an agreement stating he’ll never throw another Pokémon themed party again, typically what much larger companies do to such small cases such as these, but I guess The Pokémon Company doesn’t have that kind of decency.

          They’d rather gather their measly 4k with the 1.5 billion they make every year. Yep, it’s all this guys fault for tarnishing their reputation… LOL.

                Exactly why I barely use Miiverse these days. I use it to talk about WWE when watching Raw, Smackdown, and their PPVs and for liking, in the case of Miiverse: yeahing, drawings. After I do those things, I distance myself as far away as possible from it. Sad because it use to be awesome when it first started. Then the god forsaken updates of 2014/2015 started rolling in. But before that, it was harmless drawings getting flagged & deleted for being “sexually explicit” when they were fucking suggestive at best. Never have I seen a site so rife with body shaming well endowed female characters. Good thing they don’t run Facebook or otherwise there would be a lot of famous cosplayers getting their accounts banned because there are quite a few well endowed women posting their cosplay pictures on the site. Hell! There would be a few non cosplayers getting their accounts banned because a lot of people do post bikini & one piece pictures on there, too.

        I don’t like that, he did something wrong (illegal) so he should own up too it. No one forced him to make money money off this event, he should’ve talked to the Pokemon Company and arranged something, but no, he didn’t.           You’re wrong, what should be illegal is suing someone over a fucking themed party. By technicality alone if your going to be so harsh about it, they should be suing every child that throws a Pokémon theme birthday party and receives any money at it. It’s the same concept.

          Why are you guys ignoring that he refunded all the money, and cancelled the party immediately. I mean if this guy was honestly this shady and such a whiny bitch, don’t you think he would’ve said fuck them and thrown the party anyway, chalking up the court fees later? Instead of trying to do the right thing by realizing that he made a mistake by charging for the party, cancelling it, and giving everyone their money back.

          Anyway… Isn’t that how court cases work, one party always plays the victim until we actually know who the real victim was. Even then you may never know the full story unless you knew him personally or knew every plan he had when making this event with a 2$ cover fee.

          First of all, in any case like this there is always a victim. Whether it be the company or the person they’re suing. He has every right in the world to show how displeased he is with how this went about, whether you want to call it whining, or wanting attention, that’s all up to you.

          What he did was right, regardless if the law says it was wrong. There was actually nothing wrong with that he did. That’s the problem right there, nothing he did was malicious in any way, and he clearly made it blatantly obvious it wasn’t about making money from their name since he refunded everything and cancelled the party, which he didn’t have to do. He could’ve kept the money, and he’d still be getting sued right now.

          What isn’t right, is this copyright law, and all it covers. There needs to be a fine line between actual infringement and people simply throwing fan themed parties.

          I guess that’s you’re right to follow every law even if it doesn’t fully make sense, but there is nothing wrong with anyone complaining about it, or people who are capable of looking outside of that. As I said to Deepsouth, if people followed every stupid law, the world would be a much worse place right now. Just think how many times in history people had to fight against ridiculous laws, so we could have a better future. And here you guys are saying it isn’t right for people to do this, they should just shut up and stop being such attention whores… That is where I completely disagree.

          Yes, this isn’t that huge of deal this one person, but I’m thinking of the bigger picture and anyone who could have this happen to them. Not just one person, and it isn’t right for people to be sued over things like this, it is crossing a line.

            I was picked for jury duty, my very first Jury Summons, this week, got picked to be on the Grand Jury, & the ADA working on the case we were given that day flat out said sometimes common sense & the law are at conflict. The words straight from a man of the law, no less, said this to us! Anyway, that’s all I’m gonna say on that subject as we all know jurors are not allowed to talk specifics.

      2. This guy has hosted a Pokemon themed party for years at one of the biggest gaming events in the world without permission. He charged money at the door to enter the party. I can assure you with 100% certainty that the Pokemon Company has warned this guy before. He has more than likely become a thorn in thier side. He has probably ignored the warnings. The fact that this guy had a settlement worked out, and then went on to cry and complain on the Internet just to gather sympathy, made me lose all respect for this guy. He broke the law. Own up to it. It doesn’t matter if there are bigger fish to fry. Have you ever been pulled over for speeding, only to tell the officer that pulled you over that EVERYBODY was speeding too? The cop say, “I can’t pull them all over!” What do you do? You pay the ticket and move on.           And how can you assure me with 100% certainty. Do you have a statement directly from The Pokémon Company saying those exact words? Last I checked they refused to make any comments on the matter, I’m open to being proven wrong, but it doesn’t seem like you’re sure of what you are saying.

          As said yourself, you assure me with 100% certainty, yet you then completely contradict that entire remark by saying “He has probably ignored the warnings.” Probably doesn’t sound like 100% certainty to me. So which is it, did he probably ignore them or you know for a fact he ignore them?

          Do you even know if he charged for the previously hosted parties? I don’t, and maybe this was the first time he decided to charge for it.

          In actuality though, do you honestly think they let this guy do this for 5 whole years without doing anything about it? Especially if they sent him multiple cease and desists letters? That doesn’t even sound logical, any other company would have sued him after he ignored the first one.

          I also made it pretty apparent that I would have been fine with all this if that was the case, but it doesn’t add up. You don’t send someone cease and desists for 5 whole years.

          So I tend to believe this guy for the time being, saying he never got any cease and desist letter. Until you can see what both parties have to say from the courts information, you cannot say otherwise, either.

          You people are also trying your best to paint this guy out to be some monster for fuck sake. He refunded all the money after being told about this, he cancelled the party, I mean what a god damn money grubbing monster. /s No shit he is complaining about it, why wouldn’t he.

          Knowing all this, it was completely unnecessary for The Pokémon Company to take it this far. The guy got the point obviously, and he did everything to rectify the issue, and they still want to prove nothing other than being assholes about it.

          I could even understand if they asked him to stop, and he threw the party anyway, but he didn’t. Anyone agreeing with this is just being a total dick about it. How you can’t see there were plenty of ways The Pokémon Company could have went about this in better ways, is totally beyond me.

          This was a fan party, he wasn’t selling marked up Pokémon merchandise inside, they are even listed as unofficial themed parties, letting everyone know The Pokémon Company are not responsible for it.

            I got pulled over a few months back for not having a red flag on a ladder sticking out of the back of my truck. The law is it cant stick out further than four feet without a red flag attached. The ladder was barely at four foot. So the cop wrote me a ticket. 120 bucs. What an asshole, and what a dumb law… But did I cry, whine, and try to garner sympathy from strangers on the Internet about it? No. I paid the ticket, and went on with my life.. Even though I felt I got treated unfairly by an asshole cop… Sometime life sucks. Suck it up, and move on..

              I’m also not saying the entire Pokémon Company are assholes, I’m saying they are complete assholes for bothering with something so harmless. And there isn’t any way it would have affected them negatively, that I can assure 100%.               And no, as I said earlier, plenty of larger companies have a done a better job at handling situations like this. For instance Microsoft for Christ sakes, let me repeat that, Microsoft… They said did not care if you had a pirated version of Windows 8, they said everyone gets Windows 10. And here is The Pokémon Company suing some little guy over a fan party for 4 grand.

              Anyway… I think this argument ended right when you said you could assure me 100% of what you said, and now you’re saying you cannot. If you can’t even get your own facts straight, not much point in continuing this further. I mean I have no problem with people making mistakes, but when you tell me you know for certain, only to tell me the complete opposite afterwards, it makes it very hard for me to take anything you say seriously.

                  So to make it even more clear, I specifically said people “like you”, not you. Which you took out of context and somehow turned it into me saying you defend slavery laws. That does not mean you did support them, does it? I said there were people “like you” defending unjust laws that are clearly wrong, the same as this, with this dumb copyright umbrella law. To make that point that you should not be defending laws you do not agree with, laws that are wrong and being taken advantage of.

                  And even after describing in great detail why I didn’t specifically say you’re defending slavery laws, you still don’t get it. I included you into a group of people who defend laws that are unjust and just accept them because they are told to do so, that was all. As I said, I use extreme examples, to make an extreme point. I didn’t say you believed in slavery, I didn’t say you defended those old laws. I said your actions are relatable because of the fact you choose to just “suck it up” when you even agree that they are assholes for doing this, and you literally agreed in saying not all laws are right.

                  You are right about consequences. Again that’s been my entire point and the obvious difference between you and me, just like the consequences this guy is facing. I’d rather take those consequences any day, rather than just pony up like you are suggesting. You may feel it’s okay to do so, but I don’t.

                  And again, if you didn’t get the whole MLK thing, after all the things you said about people needing to just shut up and move on… Then again I don’t know how else to describe this in any simpler terms. Sure, none of this will or ever be as big as things like slavery were, that wasn’t the point, I’m not comparing the two in that sense. It wouldn’t matter what historical figure I used as an example, either. I really hope you understand this now. The point was that no man or woman should just sit down and shut up, simply because they’re being treated unfairly. And that’s exactly what you said people should do.

                  And my belief is only based on how you presented yourself in this argument. You’re the one who makes yourself look that way, I’m not the one writing what you’re saying. Maybe if you didn’t come off so submissive with all the stories you told, let alone telling people they should just suck it up and move on, which literally means do nothing about it, not hard to see the context there, I honestly wouldn’t be harping on it.

                  And true, maybe that isn’t what you meant exactly, but that’s you’re fault for wording it poorly then, just like when you assured me %100, only to change what you meant afterwards. I’m guessing you also didn’t exactly mean that people should shut up and do nothing about the wrong doings in their lives, but unfortunately that is how you said it.

                  Everything I’ve written is in complete context to what you’ve said yourself. I know my examples are absurd, but that’s exactly why I’m using them, because the statements you made about people needing to just accept defeat in life, is absurd to me.

    Seems like their case wasn’t as strong as they thought. And I laugh at the idea of TPC thinking they’ve been badmouthed. There’s a difference between being influenced by what the accused party has to say and considering this kind of persecution a shitty legal practice in the first place.

  4. To all the people who are essentially saying “What the heck” concerning the Pokémon Company’s actions, we don’t know the whole truth. We only heard from this one random guy’s comments. Whenever what he actually says is true or not has yet to be proven as we neither have the evidence nor witnesses to confirm that he’s telling the whole truth.

  5. He doesn’t have to bad-mouth them though. They unfortunately are just looking like dicks on their own… It shouldn’t be this big of a deal. Unless this guy got rich off the parties I feel like hitting him with a cease and desist type of deal would’ve made more sense then all of this. But this is how the internet works sometimes. You take legal action against a fan without explaining WHY you needed to and the internet peoplez will flame you on message boards and lose some respect for your company even if they still buy your products. Maybe they’re right in their lawsuit and just don’t want to put this all out there in the public but it doesn’t matter. The internet looks into things like this and judges them based on what they see, and from what’s gotten out they look like they’re kind of being dicks. :/

    Here’s hoping this is all resolved rather quickly for both parties involved though.

      I’m just basing most of what I say on the fact the guy didn’t continue to throw the party, he cancelled it upon hearing of this, and refunded every single dime he had gotten back to everyone. To me that doesn’t seem like he ever had any bad intent by charging for it.

      And I personally think The Pokémon Company wouldn’t be getting trashed on right now, if they took all of it that into consideration also. I just don’t see the point in suing the guy for money, do they have the right to stop him from throwing these parties, by law, yes (although I don’t fully agree with copyright laws.), and they do for money as well. But my entire point has been that they didn’t have to be so harsh about it, let alone even when he owned up to it, offered to pay them the money in a year, given his financial circumstances… They refused.

      I just don’t understand how anything this guy is doing is making The Pokémon Company look bad, everything they’re doing is making themselves look bad.

    Lesson learned. Never throw a Pokemon themed Halloween party & ask the attendants to help pay for the pizza! I’m glad this came out before Halloween or the Pokemon Company would have their hands full over the weeks after Halloween suing a lot of poor people that can’t afford to pay their outrageous fees.

    The Pokemon Company is making sure to scare everyone now before Halloween, so they won’t end up being even bigger monsters later when they go after everyone that can’t afford to fight them & end up on the streets having to use homeless shelters for food, water, & a comfy place to sleep because they charged a few cents/bucks that didn’t even go into their own pockets.

          1. And that was the whole point. I don’t think TPC ever believed they could stop that, nor would they want to. Believe it or not, TPC (in my opinion) does not want to stop people from throwing parties. They just don’t want people to throw parties without thier permission at one of the biggest gaming events in the entire world, PAX. Very few events are larger than PAX when it comes to video games. They like to have complete control of their advertising. Like surgical shotgun blasts, they aim thier advertising where it would reach the most potential customers, and be cost effective simultaneously. This guy was messing with that balance. They don’t care about private parties, I assure you. (I assure you is really just a figure of speech, at least when I use it. I know how you like to take everything so literal) And if it turns out they do, then I will side with you.

        1. Of course I believe in the right for people to protect their brand or IP’s. You must not be reading much of what I said if you have not understood that by now.

          I disagree with the fact the copyright law can extend this far, that is my gripe, parts of the copyright law that I feel should be illegal to enforce. A fine line between infringement and people appreciating the brand with fan themed parties. Because when it does become a blanketed mess such as this, it ends up being ridiculous in all the things these people could sue someone over.

          Things that are causing these companies no trouble at all, or ever could, and clearly didn’t for the previous 5 years he threw theses parties.

      The reality is, at some point you have to draw a line. And when that line is drawn your going to look like an asshole. Your going to be an asshole. But it had to be done to protect your company, your product… It was a line that had to be drawn. Some people will understand, others will cry, bitch and whine….

And once again, the law may say they do, but it doesn’t mean for one second that all of what is written in this law is right.

        That’s what kills me about of lot of these laws, they’re so old most of them. Why our government doesn’t make more of an effort to update laws so they make more sense with what goes on in today’s world, not in 1976…

        Hell, the last time they revised it before then was 1909… As if this doesn’t prove my point that I’ve been trying to make this entire time…

But if the President of the United States, and the good for nothing lousy ass Republican run Congress can’t fix these laws, how in the hell do we have any chance? I made the point that I could have fought my ladder ticket, and probably won. But at what cost? Five hundred dollars? A thousand? This guy (going back to topic) could fight TPC, or he could come to grip with reality. You learn that in life. You want things to change, you want to make things better, but reality usually whips your ass. Yea, not very inspiring I know. But I never claimed to be a motivational speaker.
