Nintendo’s lawyers have been out in full force this week and have taken down No Mario’s Sky due to a copyright claim. However that hasn’t stopped the team of four who were behind the game as they have cheekily relaunched the game as DMCA’s Sky. The team have also changed the game’s description to the following:
“Spaceman Finn search for Princess Mango in an infinite universe.”
“Featuring crazy Moombas, An Infinite Universe, Muscle, Amazing Physics and a Radical Space Ship; DMCA’s Sky is the hackneyed remake-gone-mashup you’ve been craving.”
ASMB who created the game in just 72 hours also put out the following statement due to the takedown notice. The game is free and is available to download, right here.
“No Mario’s Sky is no more-io! Due to a copyright claim by Nintendo we’ve had to take the game down”
“Thanks everyone for playing and enjoying our little fan game. We would love to see an official Nintendo game in this style – a Mario Galaxy-style game in 2D within a procedurally-generated universe.”

They changed Goombas to “Moombas” but they put the Mario name on the title. They couldn’t be any more stupid.
That’s the changed description, after they relaunched the game under a different name.
It’s all clearly stated in the article, actually.
Games I never even heard of are being taken down.
If they just would have gotten Nintendo’s approval, the game could still be out. Not only that, but they could have even been allowed to put the game on the Eshop, and charge money for it. Nintendo is very supportive of Indy games and with a few tweaks to the name and character this game could have made the creators some money. Some people’s kids, I swear.
Still baffles me why they used Mario in the first place if they planned on releasing it to the public. Just use your own characters. Nintendo’s properties/characters are not public domain. My lord. It’s getting old hearing about all of these fan-games being taken down.
You can use any character you want as long as it’s a parody.
I specifically said if they planned on releasing it to the public. Which they did.
If it would have just been a video showcasing their parody game, that would have been fine. But releasing it is where they goofed.
