Today, the U.S. District Court for the Western District of Washington imposed a 40-month sentence upon Gary W. Bowser, one of the leaders of the Team Xecuter criminal enterprise, which created and sold console-hacking software and devices used to play pirated Nintendo Switch games.

Nintendo appreciates the hard work and tireless efforts of federal prosecutors and law enforcement agencies to curb illegal activities on a global scale that cause serious harm to Nintendo and the video game industry. In particular, Nintendo would like to thank the Federal Bureau of Investigation (FBI), Homeland Security Investigations (HSI) of the Department of Homeland Security, the U.S. Attorney’s Office for the Western District of Washington, the U.S. Department of Justice’s Computer Crime & Intellectual Property Section and the Justice Department’s Office of International Affairs for their significant contribution and assistance.

  1. We all made these “So what are you in for?” jokes but to imagine now it really has happened! Someone really is in jail over video games!
    Also, so long Gary Bowser!

  2. Are we forgetting Anonymous, Lizard Squad & The Sony Guardians of Peace
Pretty sure that they got prison time for a data breach, DDOS attacks. When Sony paramount pictures was gonna release a movie about South Karea The Sony Guardians of Peace intervened because supposedly Sony employees was getting threatened.
Gamers mod games all the time with custom save files with Save Wizrds. They have custom consoles, lag switches, modded accounts, god accounts. They use jailbroke software, do they go to prison. No they get banned from the network.

Even in competitive Esports like the MLG, gamers use Aim bots. They don’t go to prison, they get perma banned from competing and the dev’s ban them from their servers. Like that one dude from the United Kingdom they caught using a Aim bot in competitive Fortnite in the MLG. Did he get prison time, no. He got perma banned from competing and banned from the dev’s servers.

    1. The dude you been talking about who been aim botting players in Fortnite his name is Jarvis and he was banned forever by Epic Games for cheating even so Epic Games don’t allow Mods, Hacks and Cheats from small and big gamers. Its basically part of the companies policy. If people started hacking the game or started cheating by getting more views or subs on there channels, then that would lead them to the wrong path on getting back on Fortnite.

Yeah, you can’t go to prison for cheating or mod games because its not the law and it doesn’t make any sense.

    2. Why would someone go to prison for cheating in a game? Do you have any idea what happens to inmates in prison, at all? lmao. Some nerdy dude who’s only in prison for cheating in a video game would be seen as “fresh meat” in there and willl become every other inmate’s plaything, experiencing hell on a daily basis. You really think someone should experience life-long physical and psychological trauma just for a video game? Then there’s the ramifications of your ignorant comment. If you can go to prison for something as irrelevant as cheating in a video game, then that opens up new ways for cops to incarcerate people for the simplest of things, which would make the justice system more flawed and backwards than it already is.

Everyone’s entitled to an opnion, but they’re not entilted to a ignorant one. Educate yourself before making such asinine comments lol.

      1. What? He isn’t going to prison for cheating in a video game, lol. He is going to prison for making millions by selling devices that allows to pirate games on the Switch

    3. Man, I remember when anonymous used to be vigilantes that would expose criminals the cops were too incompetent to track, and then they turned to a group that did practically nothing of importance.

  3. Fair enough.
Well the 1st paragraph of this article says “They created and sold console hacking software” am i left to assume having a custom console is against the law, but using mods isn’t. Unless the dev’s approve and a higher authority approve it.
I kinda see, i mean Skyrim anniversary edition has content from the creation club. Bethesta tested it, but they didn’t create it. The creation club content is from the modding community.

But, pretty sure lag switches are illegal and sold on the dark web. It might not warrant prison time, but still it’s illegal. Maybe they need to change the policies. Because using jailbroke software is against the Terms of service, but using mods isn’t unless the dev’s approve it. Sounds like a double standard.

    1. Creating and selling console hacking software, is unlawful because you’re allowing others to engage in “piracy” and you’re profitting from it, at the expense of another company. Just like people who hosted ROM and Emluator websites. You’re actively engaging in piracy, encouraging piracy, profitting from piracy, and costing companies millions of dollars in losses. Obviously, they’re not gonna waste time arresting and charging people who play said roms and emulators, in the same way they aren’t going to arrest and charge everyone who cheats and uses hacking software on their consoles. It would be a waste of resources, time, it would be a pointless distraction because they can’t arrest everyone who does, and it’s not a criminal act that threatens other’s safety, wellbeing, or lives. Therefor the “suppliers, creators, and sellors” are the ones held accountable, you can stop the source, but not the sources it spread to.

No, it’s not a double standard. If the dev’s approve of the mod, then it’s not unlawful and it’s not not at the companies expense since they approved of it. No duh lag switches are illegal, so is downloading roms and emulators, thanks captain obvious. No, they don’t need to change policies. Jailbroke software encourages piracy and cheating, it goes against the company, while mods approved by the devs…..are approved by them, why would something approved by them be against the Terms of service, like how obvious does it need to be for you to get it?

Again, educate yourself before making such asinine comments. You’re like an internet Karen who overreacts to everything and suggests that even the smalllest and simplest of crimes deserve the harshest consequences.

  4. Ok FBI and HSI, now use that same energy to lock up the real life Bowser that assembled a violent mob to try and overthrow the election.

  5. Maybe had you actually read my original postyou’d see that i clearly said “they don’t go to prison” They get banned from the network. Maybe had you actually read, and not just jump to a conclusion and not make blind post.

I havd no knowledge and can’t grasp simple concept “i can actually reading” without skipping over the important part.
So, yeah educate yourself and head to your local pre-k library and learn to read.

  6. That explains the ramifaction of your ignorant incoherent rambling. Maybe next time you decide to analyze post and act like a defender of public fourms you’ll get your facts straight and learn to grasp simple concepts.
No duh Gary Bowser got 40 months for piracy. I was making an example by comparison “genius”
You have an ego if always right never wrong
And that makes no since because I couldn’t careless about your incorhant rant because you couldn’t be bothered reading.

Hang on while I climb your ego and jump to your IQ. No duh Gary Bowser got 40 months for piracy

No duh GARY Bowser got 40 months for piracy. You must of thought long and hard.

  8. My original post was in response to the 1st comment about how we all make jokes about being in prison over video games and how now it actually happened. As if Gary Bowser is a 1st, that’s why i mentioned Anonymous and Lizard squad. My original post wasn’t in response to the topic created by My nintendo news.
I mentioned Save Wizards and various other jailbroke software, because others break the ToS and Code of Conduct on a daily basis andd don’t get a prison sentence.
But let someone use console hacking software that allows gamers to play pirated games, and make a profit or basically stealing from Nintendo and it’s a crime against humanity.

Didn’t think i’d have to be that specific, unfortunately some can’t grasp simple concepts or get the jest of things unless it’s literally spelled out pre-k style.
