Judge Reduces $30.2 Million Infringement Awarded Against Nintendo 3DS

An inventor who claimed Nintendo’s 3DS device infringed upon his patent for 3D technology that can be seen without the assistance of glasses had his award cut in half and declared “intrinsically excessive” by a judge on Wednesday, Reuters reports. Seijiro Tomita, who was initially awarded $30.2 million in damages from the lawsuit, will be forced to accept exactly half that amount, or run the risk of receiving nothing at all. He must decide by August 23rd whether or not to accept the reduced sum. If Tomita refuses, the suit will progress to a new damages trial that could rule against him.

This is not the first time Nintendo has faced a patent infringement suit. The judge in Tomita’s case also made note of the fact that the 3DS hardware alone has not been profitable, and that the majority of its games do not use any technology resembling that found in Tomita’s patent. Charlie Scibetta, a spokesperson for Nintendo, had the following to say about the decision:

“Nintendo respects the intellectual property rights of other companies and is confident that none of its products infringes the asserted patent. Nintendo will appeal the jury’s verdict and reduced damages award to the court of appeals.”

    1. Because what Nintendo use is infrared, what Sony use is light detection, there are two different kind of technology.

          1. Well, in 2006 Sony PAID hundreds of media outlets, bloggers and reviewers to diss the shit out of Wii, calling it a gimmick at every opportunity; their fans themselves did all the shit talking on the internet, have you forgotten?
            I don’t really care if you call me a dork for liking Nintendo better, that’s a subjective commentary and a fallacy in itself since you don’t really know me, but there’s something I can say about you and your company of choice; YOU’RE HYPOCRITES, you copied Wii with Move and praised it AFTER YEARS OF TALKING SHIT.

      1. accually nintendo also uses light detection, it detects and tracks infrared light using a camera tuned only to infrared lights. whereas the move uses a normal camera and tracks normal light. Its the same technology just reversed and tuned to a different spectrum.

        1. Yup, it basically uses light instead of the actual motion the Wiimote does, but this is ultimately just a way around an obvious copycat.
          Nintendo cannot sue over the tech used because Move does indeed work differently, however, the concept is so similar that it is mind boggling.

      2. Infrared is used for the pointer, the Wiimote and Wiimote Plus use threedimensional motion detection as their main source for input, just like Move does.
        Move is so similar to Wiimote that not even its publicity could be different.
