Nintendo To Pay A Percentage Of Future 3DS Sales To Tomita After Losing Lawsuit

Nintendo has been told it must pay a small portion of all future 3DS sales to another company, according to a court ruling from a US judge in New York Southern. The lawsuit gathered evidence that Nintendo infringed upon patented camera technology, belonging to Tomita Technologies, and used it without the company’s permission. The court ruled in favour of Tomita last month, saying that Nintendo must pay the company “1.82 per cent of the wholesale price” for all future 3DS sales.

Tomita Technologies has been keeping Nintendo on its toes since 2011, when the company filed for infringement against the gaming giant for using its patented 3D technology. Tomita was initially awarded $30.2 million in damages from the lawsuit last March, but an enforced ruling from the court reduced the damages to $15 million after the first sum was deemed “intrinsically excessive”.

    1. They should. NIntendo’s gone to court 3 times on this and this fucker finally got a judge to do this.

      And the thing is, its not even a valid claim.
      NIntendo’s 3D Camera doesnt even work the same way

    I don’t think anyone has used their camera beyond confirming that the image quality is atrocious.

    1. I used it all the time. After they killed Swapnote, the camera proved useless. It is cool, however to transfer pictures from my 3D camera to my 3DS so I can look at them. The 3DS can display much better quality than the camera is capable of.

    2. That camera is so ppor, I tried taking a photo in a moderately-lit room (no lights but a good amount of light was coming from the Sun), you couldn’t tell what the photo was supposed to be. Nintendo should just scrap it altogether.

  2. So the crappy-ass camera that no one uses and has caused controversy with children finding porn on their 3DS has become an even bigger burden for Nintendo as now they have to PAY for the crappy-ass camera…

    I think it is safe to say that Nintendo won’t be including a camera in their next hand held system. It’s SOOOOO not worth it.

    1. It’s not the camera that’s the problem. They allegedly ripped off the 3d technology itself, the tech the screen uses. The fact that the tech was developed by a camera company is misleading.

      The follow up to the 3DS will not be allowed to have a 3D screen now Nintendo has lost this lawsuit so what will the point be?
      Nintendo is slowly losing the plot.The Wii U has been a massive flop, and now the 3DS success now was not even down to Nintendo innovation but another company they copied!!

      The 3DS follow up is already doomed, Nintendo will not be allowed to use a 3D screen, and for people who say the 3D is a gimmick lol it was the 3DS major selling point and why it has sold 38 Million more than the non 3d Vita!!

  6. Just get rid of the 3D Nintendo, the majority of your fanbase doesnt care for it anyways, just Call it the Super DS, or Super Gameboy, or whatever just get rid of the 3D because its seriously crippling games.

    (Pokemon X and Y are good examples) if the option for 3D wasnt there the game wouldnt have been limited.

      The first lawsuit Nintendo lost to them was about the screen which the judge ruled in favour of Tomita and ordered Nintendo to pay 30 Million.
      This new lawsuit is about the camera which again they have lost!!
      Best 2 features of the 3DS were not even Nintendo’s own ideas….PRICELESS!!

    1. It was both, the first case they lost where they had to pay 30 Million was for the screen, this new lawsuit was for the camera.
      Just proves Nintendo are not the kings of innovation more copy cats!!
      They thought they could steal someone else’s idea from a company not that many people have heard of thinking they would get away with it!!
      Worst start ever for Nintendo in the year that will decide if they stay in the home console market or not!!

    Just as they are Nintendo they think they can steal stuff and no one will say anything and have now been seriously owned losing twice in the last 10 months!!!

    This just proves that Nintendo are slowly losing the plot.
    Wii U is dead and this will totally hurt 3DS sales moving forward!!

      1. besides he’s obviously a patent troll.. he just keeps filing new patents, none of which have had to go through any field testing (so no one knows if they’ll actually work) and waits til someone develops something that is remotely similar..

        a fine of 15 million also implies that there was a certain similarity but nothing more… if they had actually copied anything the fine would definitely have been higher

Meh, although its sad that nintendo lost to this, nintendo still has many companies backing them up, such as sega and capcom workin on projects that I reckon will put nintendos stuff back on the map, lets just hope something disasterous doesnt happen like “Microsoft buys Gamefreak” like what happened with rareware :/
