Meme Run Was Apparently Pulled From Wii U eShop Due To Copyright Claim

You may have noticed that Meme Run mysteriously disappeared from the eShop yesterday. Its disappearance surprised many as there was no prior notice of the game being pulled by Nintendo from the store. Thankfully someone on Reddit has clarified why the game was pulled and it was actually due to a copyright claim. You can read all about it, right here.

To keep it brief, I own the copyright to the Trollface image, and seeing as the image was the ‘star’ of Meme Run, I sent a DMCA takedown notice to Nintendo and want to try and settle the matter amicably. I don’t really intend to have a discussion on fair use or explain my motivations beyond the fact that my business with other parties compels me to make sure that instances of copyright infringement are addressed and resolved. Typically the result in these matters is simply having the use of the image be credited, recovering some kind of monetary compensation, or simply have it removed from the work.

To that end, takedown notices are a necessary first step to quickly open a direct line of communication with the offending party and work on remedying the situation.

I did try to reach out to the creator earlier this year and obtain the information I needed, but he claimed that he was not at liberty to speak about his relationship with Nintendo or any of the particulars regarding the game’s sales data. My lawyer had been busy working on another case (which I am actually not at liberty to talk about lest I void the terms of our agreement) and I prefer to let him handle the matter of my legal representation, so I sort of dragged my feet on actually setting this in motion so he could wrap up our current case.

    or that the stupid game got taken down.

    1. Well, technically, he does have copyright over any creative properties he creates for about 70-ish years (I forget the exact number). All he wanted was some credit, as is common in any artistic or creative fields/industries. Even a simple thanks to NASA for providing pictures of the Earth for reference is common. He contacted Nintendo to take Meme Run down, rightfully, since the developer took tons of people’s creative properties without giving any of them credit. Maybe this will be a slap in the face to actually communicate with the people you borrow from.

    Anyway, i hope Nintendo learned the lesson, that scam was meant to be on newgrounds not o the eShop.

  5. Regardless whether it’s a troll face, it’s owned by the creator. I had no fucking clue why it was made in the first place and I consider it an abomination. It’s like the Trolls flag for their victories. Fuck them trolls, period.

    Now regarding the game… well, I could care less about it but what about those who enjoyed it? It’s a mediocre game but it had its fans and the YouTube videos gained insane views. How will this affect them? Well, search for new content I suppose but this game will most likely go on other platforms so I doubt it’ll disappear. If it does well too bad for those looking to buy it but in my case, good riddance.

  6. Also if Scalpers indeed sell Wii U’s with a pre-downloaded Meme Run and sell at a high price… and people actually bid for it, I’ll be wondering for a long while… just where the fuck is the value.

  7. I noticed it was gone, but I never would have guessed it was for a copyright claim, however sketchy.

    I thought it was Nintendo’s own doing because they finally realized what a piece of crap Meme Run is in the first place.

    By US law, just because something’s open in the internet doesn’t automatically mean that it’s in public domain.

    The person suing Meme Run’s taking advantage of this fact.

  9. Horrible game never deserved to be on a Nintendo console. Hopefully Nintendo has learned their lesson not to accept any trash thats thrown at their feet.

    Troll face is trash too, and it only became popular because it was a free to use picture for youtubers without getting a fucking copyright strike! lmaoo Once he starts pushing copyright cases people will stop using the troll face, and it’s popularity will fall!! What a fucking dumbass!
