Nintendo issues multiple DMCAs on modding site GameBanana

Nintendo has issued multiple DMCA takedowns targeting mods hosted on the popular community site GameBanana. According to member ‘Waikuteru,’ over 60 DMCA takedowns were issued within a few days, with 40 directed at their own mods. This wave of takedowns has left Waikuteru’s GameBanana profile devoid of any mod submissions. The targeted mods include a variety of custom content for popular Nintendo titles. Notably, mods for The Legend of Zelda: Tears of the Kingdom, such as a randomizer and custom maps like Lon Lon Ranch and Skyview Temple, have been affected. Additionally, mods for Super Smash Bros. Ultimate have also been targeted. When visiting the mod pages in question, users are now met with a message stating that the content has been removed due to a verifiable DMCA takedown request.

Waikuteru has expressed interest in issuing a counter notice, citing doubts about the authenticity of the takedowns. If the takedowns are genuine, Nintendo would have 14 days to respond. In the interim, Waikuteru has uploaded the Zelda mods in question onto MEGA.

    You just have to do that legally, end of story

    1. The problem is on monetization of modding than modding (like patreon)
      Modding is acceptable itself without monetization (but may be takedown ?)

        Mods on Switch need a modded console, and that is one of the reasons they don’t allow it. They also don’t like their games being changed without their approval.

            1. Did you play a mod in your life ? It doesn’t require a modded rom, just modified files to overwrite or complete existing ones (so it needs installation of the game before on most case, not a modded rom).

              You confuse rom hack which is illegal (and not the subject) with mods for a game.

I don’t think he meant that a modded ROM was needed, but most people that play emulators use pirated Roms (ei; illegally downloaded) to be fair, most people using emulators don’t dump their Bios or ROMS have a know how on how to dump BIOS and ROMS, let alone have the hardware to do it. And doing everything yourself is the only way it isn’t considered illegal.

                1. Mods are just a set of file(s), not the full game. Gamebanana doesn’t provide full roms, and the subject is about mods only.

Because they own the Intellectual Property of the game and by definition, copyright gives this right to them, to stop people from using IP against their approval like they are the assets of a third party and not the company’s property. That is basic copyright. Nintendo sells a limited license to play the games, not to allow people to use assets, copyrighted titles and names for their modified versions.

        2. thank you for speaking some sense. people don’t seem to understand that copyright and intellectual property laws have only existed for just over 100 years and serve the SOLE purpose of benefiting corporations like disney and nintendo. we have let a very small number of rich people decide how infromation gets distributed. laws don’t come from nowhere, they aren’t some kind of immutable moral ground, and things like this are often decided on primarily by the rich and powerful and are thus often purely in their interest alone.

Nintendo has ALWAYS been this way, they have always been very and extremely protective with their IP. So who in their right mind goes into a project thinking that They won’t get hit with one? Especially after monetizing it. And the moment you put a donation link, it stops being a passion project. They’re either extremely ignorant to the industry, or arrogant.

Anyone that doesn’t support Nintendo Should, and I wholeheartedly encourage them to stop their support for them, completely.               1. Did it really help? Because the complaing wasnt the reason Sony did that, it was because STEAM went ahead, ignored their own 2 hour play return policy, and refunded everyone. And the refunds came after the fact that Sony wanted to implement PSN forced logins to HD2. STEAM only did it because PSN covers roughly about 70 countries, but STEAM sold the game in over 190 countries. Not only that but the pages for both GoW Ragnorak, and Until Dawn on the PS website say that PSN logging’s are required to play in PC. So did complaining really help?

                Tell me this, because the bitching is louder than ever now. Has Nintendo stopped handing out these C&D letters since the complaining started? Because to ME, Nintendo has become a ton more aggressive. But maybe in not really up to date on this.

                  1. No, STEAM did it to save their bottom dollar. If Sony had indeed went forwards with the mandated PSN log in, more than half of those countries sales would’ve have became useless. They reacted to their bottom dollar, and Sony reacted to theirs.

                    I too, don’t really agree with this, and yes it would suck if fan art was also hit with C&D’s, but that’s why I keep saying if you don’t like a companies policies/ideas/views/whatever you STOP SUPPORTING THEM.

                    I don’t care much for Emulators getting taken down, ROM sites getting shut, mods getting c&D’s. So it’s not my fight, and I won’t fight another’s fight. But the day that Nintendo does something I strongly disagree with, that will be the day I stop supporting them.

            3. Honestly, I dont agree entirally. I remember Nintendo hasn’t usually taken action against basic mod files, usually fan made from scratch, and Nintendo roms. Many do it probably because of assumption of reasoning.

              Even if I’m wrong here on that part, I still think many of the modders are victims because just because Nintendo often does this (assuming though) doesn’t mean it’s right. And I don’t think it’s fair to argue that we now have to morally suddenly avoid modding the game innocently just because of how likely they will take it down. What if Nintendo someday changes their mind. Keep lawfully complaining about Nintendo doing this for the right reasons. I want many popular platforms to properly complain about Nintendo.

The only nerd willing to even go through the trouble of loading up that custom map has probably bought Ocarina of Time five times and every other zelda twice.           As for those who still think that emulation is legal…in this specific case, it is not legal since it violates copyright, put that in your head once and for all instead of player with stupid vigilantes.

    6. Going after Game Banana is just stupid.
      This is not a site that hosts full roms for people to download, it’s a site for downloading mods for games you personally have dumped. Yes, there are sites that let you download games for free, this is something even I do not support and actively support Nintendo taking down, but modding really shouldn’t be affected here. Just because little Timmy downloaded a Lon Lon Ranch Mod for Zelda TOTK doesn’t automatically mean Nintendo is gonna lose money, if anything it means he paid for the game.

      And before anyone comes at me with “Nintendo is in the right legally” then I say this; Save it.
      Of course Nintendo is in the right legally, anyone with common sense would know that, but there’s a difference between protecting your IP and just being an asshole. Right now Nintendo is being that spoiled brat that refuses to let others play on his game consoles. Yeah, the brat may be in the right legally, but he’s still being an asshole for no good reason.

      As for the money side to this; This is the ONLY area I can see where Nintendo is coming from. At that point the content being sold is technically their IP which stuff like Fire Mario in SSBU or Lon Lon Ranch in Zelda TOTK would be Nintendo’s IP.
      But honestly, 99% of mods I have seen are free to download. I’ve downloaded plenty of models from that site and not once have I had to pay.

      Nintendo, grow up, stop being that spoiled brat.
