It’s no secret that Nintendo is not a fan of piracy. However, this year is becoming pretty infamous for being very full of Nintendo taking legal action against many different people and companies. Nintendo has been particularly strict about the piracy of Switch games, and the vast majority of their legal pursuits have been in regards to that.
This is no exception. Nintendo has sued Jesse Keighin, known online as EveryGameGuru. Nintendo is claiming that Keighin streamed Nintendo Switch games that were emulated. In some cases, said games were not officially released yet, including Mario & Luigi: Brotherhood. Nintendo is wanting $150,000 for each copyright infringement.
Nintendo also accuses Keighin of encouraging Switch piracy, directing his viewers to Switch emulators and tools. He is even cited on October 17th for telling Nintendo that he will “actively help people find newer and updated copies of Ryujinx and Yuzu” and that he stated that he was helping people play Switch games “on their PC with no need to buy [Nintendo’s] hardware”.
What makes this streamer different is that, according to Nintendo, not only did he continue to stream after getting channels taken down, but he sent a letter directly to Nintendo taunting them, claiming that he has “a thousand burner accounts” and that he can “do this all day”. He’s also accused of making money off of his streaming. He had a monetized YouTube channel that was taken down. Afterwards, Nintendo accuses Keighin of adding a CashApp handle to his streams so viewers could send donations.
Nintendo claims that Keighin has personally admitted to streaming pirated Nintendo Switch gameplay footage “on at least 50 occasions in the last 2 years”. This means that, should Nintendo win and receive the $150,000 per infringement of its copyright that they are seeking, Keighin could end up paying as much as $7,500,000.

Nintendo has always becoming the biggest targets in the world because stupid people love to pirate off their games nad products that has not been fully released yet. Greed doesn’t buy you happiness.

Good for Nintendo. I hope they win. He sounds like an arrogant moron. Nintendo’s got plenty of lawyers. They can do this all day, too. Teach the prick a lesson and every other person who thinks it’s “morally correct to pirate a Nintendo”… if you hate them so much, why play their stuff? Theft is theft regardless if you like a company and its practices or not. I don’t like pirates, but if I stole from them watch how much they’d cry about it. Hypocrites.
Emulating games is one thing since I don’t believe in the “lost sales” argument but live streaming games that haven’t been released yet makes you look like a complete moron especially when you openly taunt Nintendo and make it clear you’re doing it out of spite.
Uh, it’s obvious… 1 emulated game, it’s a potential game not bought same thing for piracy so yes, emulation and piracy in general are losses for all companies and as said above: a theft is a theft and NOTHING justifies it!

If someone planned on pirating a game implies they had no intention of buying the game to begin with. It’s not like it’s a stolen physical good that could’ve been sold to someone else who’s willing to buy it instead.
I am not defending that streamer though. He is a complete fool for antagonizing Nintendo and deserves the book to be thrown at him.
Looks like they play favorites. If they say they can sue people just for playing roms, then they should sue people like the admin of Serebii. I recall him saying that Pokemon didn’t gain exp. in gen 5 until a certain point, which is actually a piracy feature. If he was pirating BW, who knows what else the guy was pirating.
I don’t think they play favourites, they just generally don’t care unless you got a step beyond like this tool. The Pokémon Company have partnered with and sponsored people who use emulators before. SmallAnt has videos about Mario Odyssey mods up which have millions of views, but the difference is he doesn’t point people to emulators and encourage them to pirate games, he just doesn’t really address it at all.
I mean I feel like this is bit different since the this guy is using cash app to help him continue doing this, and he’s legit sending messages to Nintendo to taunt them about it, unless serebii is doing that I don’t see Nintendo going after him for quite a while this is like the equivalent of a robber looking straight into cops eyes and robbing someones house only to immediately get cuff and sent to jail

Not sure where I stand with this emulation thing. I buy my games, but I understand its seen as a grey area. But in this instance, this guy was asking for it. Not only was he caught multiple times and was asked to stop, he even taunted them. Yeah, this is one of those stories that I don’t feel bad for the guy.
The type of pirates that do it just to brag about it, deserved.
