Also I know a lot if fans got a copy so quit blaming scalpers. GameStop was intentionally listing the presale as sold out to throttle orders. I just hit refresh and voila it was for sale again. If you are mad at anyone it should be GameStop.
Bullshit, my Gamestop sold out within a few minutes, even the employees got screwed. Want to know how i know? Because i know most of the people there, some are even long time friends and they said they sold out within 30 minutes. Not only gamestop, Bestbuy and Amazon sold out aswell

Up until two years ago ticket scalping was illegal in my state but it’s still illegal in other states. So I’d say legitimacy for scalping internet purchases is still in that gray area. Besides just because something is legal doesn’t make it moral or honest.

According to ZeldaInformer, Best Buy is canceling and refunding money for orders that purchased more than one so at least they’re doing something about it! I know this is gonna sound stupid, but why all the hate for the scalper? Let me tell you there is NO way Amazon, best buy, or any other retailer is selling any product at cost, that’s stupid and would destroy a business. So what’s wrong with a scalper engaging in similar practices? ever hear the expression the early bird catches the worm? Well they got there first and pre ordered a product as any of you could have. I’m not a scalper but I pre ordered 2 of every amiibo at different retailers just in case one gets cancelled. But if they both come in I wouldn’t think twice about selling One on eBay, and I don’t see anything wrong with that. It’s business.
Mark up on these systems is very minimal, for instance a PS4 cost a retailer $370.00 plus shipping costs. So at best $25.00 profit or 7% then factor in CC Fees if a customer pays with a CC they get their 2% cut… These Scalpers, just doing their job/life is making double…. A friend of mine worked all day and was not going to get fired for wanting a MM3DS System.
Now I’m sure Nintendo might flood the stores with more systems, but it sux when some people have to potentially risk their jobs to buy something like this…
The problem is that scalpers don’t even want the product, they just go and buy it before people that do get a chance to, and then try to sell it to them 2 miutes later for double or triple the price. If you buy 2 of something and keep one for yourself as a collectible is one thing, but to buy 5+ of something with the intent of taking advantage of others is something else altogether.

I don’t see what’s wrong with this. I mean, sure, I’m upset I can’t preorder the Majora’s Mask n3DS (got the Monster Hunter one though, so whoop whoop!), but it’s a fair market price. Unlike Amazon themselves, marketplace sellers can sell at the fair market price and aren’t obligated to sell at the MSRP (which is considered an unfair price obviously since demand has significantly exceeded supply).
Think about it, though. If a seller has two of the n3DSs on him, and there are, say, two people willing to pay $500, twenty people willing to pay $400, and a thousand people willing to pay $200, you must be either an absolute saint or a retailer working closely with Nintendo to charge MSRP to still charge the lower price.
And in reality… It’s more fair. There’s somebody out there willing to pay that price in the market, let them.
It’s a simple matter of supply-and-demand, and if you’re one of those who gets turned off by the $500 or higher price, then you’re one of those people who dropped out of the demand curve. Sellers try to maximize profit by looking for the people who still demand the console despite the price.
No, it is not “more fair” for someone to get lured into shelling out double the original price of a limited product.

Just limit it to like 2 or 3. Many stores limit the number of electronics a person can buy at a certain time, yet for gaming hardware/software no boundaries have ever been put in place
It’s pathetic to see so many people who make their living by reselling wanted items for bogus prices. Sure it’s fair and legal but that’s just selfish and unfair. Stores should definitely limit the number of goods one customer can buy. It’s not like other people won’t buy the products so they’re not losing money. Also Nintendo should increase the number of products sold as well. Usually limited edition items are sold for a certain period of time not in a limited quantity. I never understood why Nintendo doesn’t have their own official online store where they can sale their products directly. This would allow people to buy any of their products at anytime and limited addition items for a certain amount of time, even if a customer had to wait on that product to be reproduced. That’ll also give everyone an opportunity to buy products from their Nintendo stores (that they believe everyone has access to.) Nintendo is a great company but they make some of the WORSE business and marketing decisions.
Also, exclusive items should be limited to “in store purchases only,” so people can’t just buy a whole bunch online. In the store, they can tell customers “one per person.”
Amazon can’t do this, but Target, Gamestop, Walmart and Best Buy can. That would really help fight against scalpers.

Horrible idea, not everyone lives in places that have good gaming shops with decent prices, I order every game online.
If they offered them through their own online store, wouldn’t a scalper just be able to purchase them in the same numbers as well? Even if you limit the number you can buy per account, they’ll just make multiple accounts.
Aside from only allowing such items to be pre-ordered in stores, the other solution for ordering online would need to have Amazon or Nintendo (if they were to ever have their own online store for such purchases) police their account information and close accounts that are attached to the same address – of course, then you might have scalpers just create P.O. Box addresses to get around it, but it would make it much more inconvenient for them to try to get multiple pre-orders on a product.
And by “close accounts attached to the same address”, I mean that they would only allow one specific address per account in the event that scalpers would use such practices to try to get around the theoretical purchase limit.
But if Nintendo had their own site they could sale the products directly. And instead of making only 500 MM 3DS’s they would just sale as many purchased for a week or whatever so that people who want them can get them. Scalpers would lose more business that way because people would be able to get their hands on a product because its time limited not stock limited. And sure the scalper could make x amount of PO boxes but that takes a but of time to order in bulk, so other customers could grab them a little more easily.

Nintendo does not make any more money because of scalpers. Amazon on the other hand does, it takes it’s % cut from the original sale to the scalper then when the scalper sells 3rd party on Amazon, Amazon takes its % cut for that sale, from a higher price set by the scalper.

I sell stuff on all major retail sites, not just Amazon. I’m not a scalper I’m in the same wholesaler position as Nintendo although a completely different market.

By the way Amazon is no longer the cheapest. They have to pay sales tax now, like everyone else does, so finally they contribute things like maintenance of the roads that carry their deliveries, or the ambulances called to their warehouse when over worked staff pass out in the heat.
