Switch modder sued by Nintendo is going to court without lawyer

You may recall that, back in July, it was confirmed that Nintendo was suing Ryan Daly, a modder who Nintendo claims runs a company called Modded Hardware that sells “modded Switch consoles and MIG switches”. Nintendo is accusing Daly of enabling players to pirate Switch games on hardware that is not modded. Daly is also accused of offering a mail-in service where customers could get their Switch consoles modded and get pre-installs of pirated games.

Since then, Daly has continued to refuse to end his business. In fact, he has now stated to court that he doesn’t believe he has done anything wrong, including having any ownership and operation of Modded Hardware. Daly is reportedly going to court without a lawyer, and the case is now going to move to the discovery phase. This means that depositions, requests for documents, and more will occur. In the meantime, Modded Hardware’s site is now private and can only be accessed with a password.

  2. Unironically might be a smart move. He’ll have so many fines to pay and he won’t have to add lawyer costs on top of that.

  3. Not sure how smart going to court without a lawyer is for something like this, but I do wish him the best of luck. Really wish someone could get Nintendo to shut up about modding consoles.

  4. This man really thinks Nintendo won’t make an example of him… they have been after ppl pirating their games for decades- he’s not walking away from this. Jail-time OR a fine probably in the 6 digits (maybe even millions).

  5. Nintendo are cute, thinking trying to end emulation at the end of a consoles life will do anything but turn enthusiests off from ever buying a Nintendo product again. I don’t believe for a second that they are solely after piracy due to that, including here. They don’t come out and say “Homebrew software is a problem” out loud because it would screw their case, not because they don’t want to. I know several people, one of whom is my brother, who are now going out of their way to emulate any Nintendo games they want to play in the future.
