Copies of these games have seemingly already been sold by unaware retailers. Assassin’s Creed Shadows is not really a big deal as the game is already out on other formats, but those hoping to avoid story spoilers for the long-awaited Metroid Prime 4: Beyond will want to avoid social media until the game’s release on Thursday.

Actually I think he is. Once they get rid of those physical copies, those streamers had no choice but to wait for the actual release instead of playing the game a week early.

From the moment you don’t respect a contract, you are at fault, even breaking the law, and Nintendo can take legal action against you for that. The other fool above might laugh at it, but that’s also part of the reasons why Nintendo is increasingly targeting digital.
Clearly, this is the final, compelling reason Nintendo needed to wipe physical media from existence. Thank goodness we have you to point out this catastrophe!
It’s a civil issue though (a contractual dispute between two parties), not a criminal issue, no law has been broken.
The most that would happen if Nintendo pursued this is they might have to pay some damages but most likely it would be a pain to chase this in the first place so they won’t bother. It wouldn’t be the first time some game has leaked early and it won’t be the last time.
Trust me, that is not the reason companies want to get rid of physical media.
It’s part of it, plus the fact that physical costs so much more to keep pandering to an outdated format/audience, and is inferior to digital in every way. Stop fear mongering, movies got cheaper going digital, music got cheaper going digital, games are already cheaper than physical in 90% of cases. Luddites need to get out of a progressive hobby.
Games didn’t get cheaper by going digital though. You can still buy physical media and it costs the exact same price as a digital version (ignoring sales that happen sometimes and skew that one way or the other) and this is despite the fact that there’s less cost to produce that digital version. They’re not passing the savings on to you.
You are just spreading lies, second hand physical is insanely cheap, and digital media ESPECIALLY NINTENDO can be priced however they want and they can never go on sale if they want physical can be borrowed and shared, the only store that does that with digital is steam, trust me one day you will complain at how the market got even more pricy and you will probably blame it on something else
